Terms of Service

1. Agreement

By creating an account or using Awareon ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms. If you do not agree to these terms, you must not use the Service.

2. Description of Service

Awareon is a content creation, brand management, and social media publishing platform that provides tools for designing presentations, managing brand assets, generating AI-assisted content, scheduling social media posts, and collaborating with teams.

3. Account Responsibilities

• You must provide accurate registration information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use
• You must be at least 16 years old to use the Service
• You are solely responsible for all activity that occurs under your account

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes on intellectual property rights
• Attempt to interfere with or disrupt the Service
• Share your account credentials with unauthorized parties
• Use automated means to access the Service without permission
• Publish content that is defamatory, fraudulent, obscene, or harmful through the Service
• Violate the terms of service of any third-party platform (Meta, Google, LinkedIn, TikTok, etc.) you connect to through the Service

5. Content Ownership

You retain ownership of all content you create or upload to the Service. We do not claim any intellectual property rights over your content. You grant us a limited license to host, store, process, and display your content as necessary to provide the Service.

AI-Generated Content: Content generated using our AI features is provided as-is. You are solely responsible for reviewing, editing, and approving any AI-generated content before publishing. We make no warranty that AI-generated content is accurate, appropriate, legally compliant, or non-infringing.

6. Third-Party Services & Social Media Publishing

The Service integrates with third-party platforms including Meta (Facebook/Instagram), Google, LinkedIn, TikTok, and others ("Third-Party Platforms"). Your use of these integrations is subject to each platform's own terms of service.

We are not responsible for:

• Failed, delayed, or incorrect publishing caused by Third-Party Platform API limitations, outages, rate limits, or policy changes
• Content removed or penalized by Third-Party Platforms after publishing
• Account suspensions or bans on Third-Party Platforms arising from your content or use
• Changes to Third-Party Platform APIs that affect the functionality of the Service
• Loss of revenue, followers, reach, or advertising performance on Third-Party Platforms

We recommend always verifying that posts have been published successfully on each platform.

7. Subscription & Billing

• Paid plans are billed on a recurring basis (monthly or annually)
• You may cancel at any time; access continues until the billing period ends
• After cancellation, your data is retained for 90 days before deletion
• Refunds are handled on a case-by-case basis and are not guaranteed
• We reserve the right to change pricing with 30 days' written notice

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data in compliance with GDPR.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted, error-free, or secure access to the Service. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, and we shall not be liable to you or any third party for any modification, suspension, or discontinuation.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that: (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) any results obtained from use of the Service will be accurate or reliable; or (d) any errors in the Service will be corrected.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Awareon, its directors, employees, agents, partners, or suppliers be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, business opportunities, or goodwill
• Damages arising from failed social media publishing, third-party API failures, or outages
• Damages arising from AI-generated content that is inaccurate, misleading, or harmful
• Damages arising from unauthorized access to your account

In any case, our total aggregate liability to you for all claims arising from or related to the Service shall not exceed the greater of (a) the total amount you paid us in the 12 months immediately preceding the claim, or (b) EUR 100 (one hundred euros).

12. Indemnification

You agree to defend, indemnify, and hold harmless Awareon and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

• Your use of the Service
• Content you create, upload, or publish through the Service
• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property rights
• Your violation of Third-Party Platform terms of service

13. Governing Law & Dispute Resolution

These Terms are governed by applicable law. Any disputes shall be resolved in the courts of competent jurisdiction. If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

14. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by email or by displaying a notice in the Service. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
